The Building Industry Fairness (Security of Payment) Act 2017 (Qld) (BIF Act) is designed to ensure the security of payment for contractors, subcontractors, and suppliers in the building and construction industry. It provides a streamlined process for making and responding to payment claims, and for the adjudication of payment disputes.

Building and construction contracts are legally binding agreements. Parties must adhere to the terms and conditions outlined within. Enforcement can be sought through the Queensland Civil and Administrative Tribunal (QCAT), the courts, or through alternative dispute resolution methods such as mediation or adjudication.

Adjudication is a dispute resolution process provided for under the BIF Act, which allows for a rapid, interim decision to be made regarding payment claims in the construction industry. It is initiated by serving a payment claim, which can be responded to with a payment schedule, and if necessary, an adjudication application by the person/entity that is owed money.

YYes, certain decisions made by the Queensland Building and Construction Commission (QBCC) can be disputed. If the decision is a ‘reviewable decision’, a party may apply for an internal review of the decision within 28 days of receiving a decision or notice. If dissatisfied with the outcome of the internal review, an application for external review can be made to QCAT.

If you encounter defective building work, you should notify the contractor to give them the opportunity to rectify the issue. If the matter is not resolved, you can lodge a complaint with the QBCC, which may inspect the work and order the contractor to rectify defects. Strict timeframes apply for structural and non-structural defects to apply to the QBCC, so please seek urgent advice upon noticing any defect.

Payment disputes are primarily handled through the adjudication process under the BIF Act. A claimant can issue a payment claim to which the respondent must reply with a payment schedule. If the dispute remains, either party can apply for adjudication.

The QBCC regulates the building industry in Queensland, ensuring that licensed contractors meet their obligations. It provides dispute resolution services, monitors compliance with the QBCC Act, and can take disciplinary action against licensees who breach the QBCC Act.

The limitation period for breach of contract claims in Queensland is generally six years from the date the cause of action accrued. However, specific time frames may apply to certain claims under the BIF Act or QBCC Act, so it is important to seek legal advice promptly.
